1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries from KnitopiaShop (hereinafter referred to as Knitopia) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

2. Contracting Party

The purchase contract is concluded with KnitopiaShop, Owner: Pia Mittendorf, Pia Mittendorf c/o Impressumservice Dein-Impressum, Stettiner Straße 41, 35410 Hungen, Germany.

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

3.2. By clicking the [Buy] button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation via e-mail immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to their trade, business, or profession), you are entitled to a statutory right of withdrawal.

4.2. If you exercise your right of withdrawal under section 4.1, you must bear the regular costs of returning the goods.

4.3. Otherwise, the right of withdrawal is governed by the provisions set out in detail in the following:

Withdrawal Policy

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us [insert company name, address, telephone number, and e-mail address] of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or e-mail). You may use the attached sample withdrawal form, but this is not mandatory. You may also electronically complete and submit the sample withdrawal form or any other clear statement on our website (insert internet address). If you make use of this option, we will promptly (e.g., by e-mail) send you a confirmation of receipt of such withdrawal.

To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; under no circumstances will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us or to (insert name and address of the person authorized by you to receive the goods, if applicable) without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if such loss in value results from handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

5.1. The prices stated on the product pages include statutory VAT and other price components.

5.2. In addition to the stated prices, we charge a flat rate of €5.95 per order for delivery within Germany and 15€ for orders with delivery in the EU. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and on the order page.

5.3. For cash on delivery payments, an additional fee of €7.49 will be charged, which the delivery service collects on site. No further taxes or costs apply.

6. Delivery

6.1. Delivery is made only within Germany and the EU via DHL/Deutsche Post.

6.2. The delivery time is up to 6–8 weeks. Any deviating delivery times will be indicated on the respective product page.

7. Payment

7.1. Payment can only be made via PayPal.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Liability for Defects

Knitopia is liable for defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code (BGB).

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR). The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
